1. Agreement

By creating an account or placing a bid on EG Liquidation ("we", "us"), you agree to these Terms. If you do not agree, do not use the site. You must be at least 18 years old and able to enter a binding contract.

2. Accounts

You must provide accurate first name, last name, email, phone number and home address. You are responsible for activity on your account and for keeping your password secure. We may suspend or close accounts that provide false information, fail to pay, or abuse the platform.

3. Bidding

Bidding on every item opens at $5.00 USD and increases in minimum $5.00 increments. Every bid is a binding offer to buy the item at that price and cannot be retracted.

Items may carry a hidden reserve price. If the reserve is not met when the auction ends, we are not obligated to sell the item.

We may cancel bids, extend, or end an auction early in cases of error, suspected fraud, or item unavailability.

4. Winning and payment

The highest bidder when the auction closes, provided any reserve is met, wins the item and must pay the final bid amount plus any applicable sales tax.

Buy Now claims are binding too: a buyer who uses Buy Now must pay the listed Buy Now price plus any applicable sales tax.

Payment is due at pickup and may be made by card or cash in store. Unpaid items may be forfeited and offered to another bidder, and the account may be suspended.

5. Buy Now purchases

Some items offer a fixed Buy Now price set by us. Using Buy Now claims the item at that price and is a binding agreement to purchase, just like a winning bid.

Because bidding may continue on the same item, Buy Now claims are honored in the order they are received. If more than one buyer claims the same item, we will contact each buyer and offer the next available comparable item to the buyer we cannot supply.

Payment, pickup, warranty and all other terms that apply to winning bidders also apply to Buy Now purchases.

6. Pickup — Arizona only

We do not ship. All items are local pickup only at our Arizona store. Winners must pick up items within the timeframe we communicate after the auction ends. Bring a valid photo ID matching the account name. Items not collected in time may be considered abandoned and resold without refund.

7. Item condition

Items are liquidation merchandise and are sold in the condition described and pictured. Please review photos and descriptions carefully before bidding. Each listing is marked either "2-day warranty" or "As is", and the policy for that marking applies to that item.

8. 2-day warranty policy

Items marked "2-day warranty" include a 2-day warranty starting on the day of pickup. If the item is defective or materially not as described, return it to the store within 2 days of pickup with your receipt for an exchange, store credit, or refund at our discretion.

The warranty does not cover damage caused after pickup, misuse, neglect, unauthorized repair, or normal wear. The item must be returned in the same condition it was picked up in, with all included parts and accessories. After 2 days, all sales are final.

9. As-is policy

Items marked "As is" are sold in their present condition with all faults, known or unknown, and with no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

As-is sales are final: no returns, exchanges, refunds, or store credit, even if the item does not work. Please inspect photos and descriptions carefully and bid accordingly. By bidding on an as-is item, you accept it in its current condition.

10. Prohibited conduct

You may not place bids you do not intend to pay for, bid on your own behalf through other accounts (shill bidding), use another person's account, interfere with the site, or use automated tools to bid.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to an item or the site is limited to the amount you paid for that item. We are not liable for indirect or consequential damages. The site is provided "as is" without guarantee of uninterrupted availability.

12. Availability and errors

Listings may contain errors in photos, descriptions or pricing. We may correct them, or cancel or relist an item, at any time before payment is collected. Items are subject to prior sale in store.

13. Changes

We may update these Terms. Continued use of the site after changes are posted means you accept the updated Terms.

14. Governing law and contact

These Terms are governed by the laws of the state of Arizona. Questions can be directed to EG Liquidation staff in store.
